COMMISSION TERMS OF SERVICE

GENERAL
1. The Artist reserves the right to refuse a commission without reason or explanation.
2. Inappropriate/aggressive behaviour of any kind will not be tolerated. Should this or a breach of the Terms of Service occur, the Artist may stop or cancel the commission.
3. Poor communication may also be grounds for stopping the commission.
4. The Client must read, understand, and agree to all the terms. By continuing with the commission and going forth with the payment, the Client has agreed to the above terms.
5. By providing the client with a line of communication to the Artist, the client agrees to act in a professional manner. Failure to comply will lead to termination of service.

PRICING & PAYMENT
1. Prices are in GBP and payments will be made through Paypal Invoice only.
2. Full payment required upfront unless the commission price exceeds £500. In such a case, 50% will be taken upfront and the rest when the commission is completed. The HQ image will only be sent when the full payment has been made.
3. Invoices are required to be paid in full after seven (7) days of sending them, unless otherwise agreed upon.
4. Prices are subject to change based on the complexity of the commission.
5. If the client needs the product before a specific date, there will be a deadline fee.
6. Final prices stated by the Artist are non-negotiable.


COMMUNICATION & PROCESS
1. Client must provide as much information as possible in their inquiry. This includes but is not limited to: clear and concise references/descriptions of their character(s), the type of commission they require and any additional resources they think may be helpful for the artist to use (e.g. quotes, moodboards, colour palettes, past commissions, etc.)
2. The client understands the artistic limits that are described here:
a) The artist will draw:

  • Fanart

  • Original Characters

  • Fantasy/TTRPG races

  • Mild gore (blood, bone, non-lethal wounds, mild body horror.)

  • Non-pornographic nudity

b) The artist will not draw:

  • Heavy gore/violence

  • NSFW and sexual acts

  • Vehicles/Mecha

  • Comics/Sequential pieces

  • Furry

  • Real People/Family Members

  • Hateful/Bigoted content (Homophobia, Transphobia, Racism, Xenophobia, Sexism, Ableism, Right-wing content, etc.)

2. The client may request changes during the sketching process. Changes applied after this check in may require an extra fee based on the nature or complexity of the change.
3. If a specific deadline has not been agreed upon, allow up to 2 months for commission turnaround. Artist cannot promise a commission will be done at a certain time unless a specific deadline has been agreed upon by both parties.
4. The final HQ commission piece will be sent through email unless another avenue (Discord, Instagram, Twitter, etc.) has been agreed upon by both parties.

REFUND POLICY
1. If the Client wishes to cancel the commission before payment, the commission will be cancelled and no further action needs to be taken.
2. If the Client wishes for a refund before beginning any work, a full refund will be provided.
3. If the Client wishes for a refund after beginning any work, a percentage of the refund will be provided at the Artist’s discretion based on how much work is done.
4. If the Client wishes for a refund after the commission is completed, no refund will be provided.


LEGAL DISCLAIMERS
1. A private non-commercial commissioned piece may NOT be used for commercial purposes and cannot be redistributed or reproduced. The Artist retains all rights to the piece of artwork itself, including the right to make any merchandise. The Client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, merchandise, etc. unless otherwise agreed upon.
2. The Artist does not claim any rights to any intellectual property or the character(s).
3. The client may post the commission on social media and/or use the commission as a profile picture, with credit to the artist. (Cole Alexander @Colealexart.) The client may not claim the commissioned art as their own work, nor claim anybody but the artist (Colealexart) made it.
5. The client may not edit, tweak, remove the watermark, or make any other changes to the commissioned piece.
6. The Artist is not responsible for providing the Client with a physical object, print, merchandise, etc. of the artwork, unless agreed upon in which a fee may be applied.
7. The client does not hold the right to reproduce or use the product in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
8. The client does not hold the right to use the commissioned art in any AI training or tweak it with generative AI in any way whatsoever.
